1. Company information
These Terms and Conditions govern access to and use of the services offered by DELAFUENTEART EDITIONS, S.L., a company dedicated to the publication, production, and distribution of sculptures and artistic works in limited editions, as well as the management of cultural projects and their marketing through digital media and professional collaborations.

By making a purchase, reservation, or contracting services through our platform, the Customer accepts these Terms and Conditions.
2. Purpose and nature of the transaction
The transactions carried out consist of the sale of sculptures and art editions developed and produced within the framework of our curatorial and editorial projects.
The contract is deemed to have been concluded when DELAFUENTEART EDITIONS, S.L. issues the Order Confirmation, and shipment will only be made after full payment for the work and shipping costs has been received.
3. The Works
The pieces offered are original sculptures and art editions created in our studio or in collaboration with artists.
Each work is delivered with its certificate of authenticity.
The images and descriptions are for guidance only: as these are works of art, there may be variations in color, texture, finish, or materials compared to the photographs.
4. Purchase process
The Customer follows the online process. When the work is added to the shopping cart, the customer is asked for the delivery address in order to calculate shipping and delivery costs. The customer will then receive an email with:
– Confirmation of the work you wish to purchase.
– Shipping conditions (method, delivery time, destination).
– Calculation of shipping costs.
– Instructions for paying the remaining amount.
The contract is finalized with the Order Confirmation by the company.
5. Prices and payment methods
Prices are expressed in euros and include applicable taxes, unless otherwise indicated.
The cost of the work and shipping expenses shall be paid by bank transfer or another agreed method.
We issue invoices in all cases, both to consumers and distributors.
6. Shipping and delivery
Shipments are made from Madrid (Spain).
Domestic and international shipping is available via specialized art transport.
The shipping cost is calculated based on the destination, type of artwork, weight, packaging, and insurance.
Delivery is made only after receiving the total amount for the work plus shipping and delivery, and is carried out exclusively by transport companies specializing in art, including unpacking at the destination.
Due to the nature and cost of this service, the amount of transportation and handling will not be considered a "standard shipping cost" for the purposes of the right of withdrawal recognized to consumers.
Consequently, in the event of cancellation or withdrawal, only the price paid for the work will be refunded, but not the transport and handling costs already incurred.
The Customer shall also bear the costs of return shipping, which must be carried out by specialized transport, following the same safety and packaging conditions as the initial shipment. In the event of a defect or error attributable to the company, the return shipping costs shall be borne by DELAFUENTEART EDITIONS S.L.
The Customer shall be responsible for any taxes, duties, or customs fees at the destination.
Responsibility for the work is transferred to the Client upon delivery.
7. Right of withdrawal and returns
Consumers have 14 calendar days from receipt of the work to withdraw from the purchase, except in the case of personalized works or specific orders.
Works must be returned in their original packaging and in perfect condition.
Return shipping costs are borne by the Customer, except in cases of defects attributable to the company.
The refund will be made within a maximum period of 14 days after receiving the work.
Custom orders are excluded from the right of withdrawal in accordance with Article 103.c of RDL 1/2007.
8. Warranties
The works are delivered in perfect condition and with a certificate of authenticity.
Variations resulting from the artisanal process are part of the artistic character and are not considered defects.
Consumers will retain their legal rights in the event of defects or dissatisfaction.
9. Liability
DELAFUENTEART EDITIONS shall not be liable for indirect losses such as loss of profits or loss of opportunities.
Maximum liability is limited to the amount paid for the work.
In the event of damage during transport, the Customer must notify us within 24 hours with photographic documentation.
10. Terms and conditions for distributors and professionals
There is an exclusive section for professionals (galleries, interior designers, art shops).
To access, you must complete a registration form, provide tax information, and accept specific terms and conditions.
Distributors do not have the right of withdrawal under B2B regulations.
Specific commercial conditions (discounts, terms, minimum orders) shall be set out in writing.
The distributor undertakes to respect the authenticity of the works and certificates.
11. Proposal of works by artists
Creators can submit works for production, promotion, and sale (non-exclusive) by the publisher using the contact form on the website.
Proposals will be reviewed by the artistic direction team.
The inclusion of works is not guaranteed and depends on curatorial, technical, and commercial criteria.
Submitting proposals does not imply transfer of rights; the artist retains full authorship.
12. Force majeure
We shall not be liable for delays or failures caused by circumstances beyond our reasonable control (strikes, wars, natural disasters, transport or telecommunications failures).
13. Communications
Notifications must be made in writing, preferably to the company's contact email address.
14. Applicable law and jurisdiction
These Terms and Conditions are governed by Spanish and European legislation on consumer affairs and e-commerce.
In the event of a dispute, the parties agree to submit to the courts and tribunals of Madrid (Spain).
